Perfect example of our court systems being clogged with pointless lawsuits. We received a small claims lawsuit for the cost of Microsoft Windows XP, because we didn't give the customer it with his computer.
The Customer purchased a $249 computer special, advertised as "$249 Linux PC, an alternative to windows". Now the advertisement stating "alternative to windows" you might come to the conclusion that this computer used something that was an "alternative to windows". I'm guessing the customer missed that part.
The invoice says.
1. Linux Pc.........Does not include Windows......$249 Note: Linux is a free replacement for Microsoft Windows. Windows is not included in this package. Package can be upgraded to Windows XP Pro for $179
Reading this on the invoice (which they must sign), you would think that you would understand that Windows was an option that you COULD purchase for $179.
Upon opening the box, is a pink sheet that states in very bold and large letters. That Windows is NOT included, and gives various options and places to learn about Linux. This was also missed.
Yes it goes to court. Judge laughs and tosses case out before customer even gets to plead his case.
